What is undue influence, and how can it be avoided?

Saying that there has been “undue influence” is often used as a reason to contest a will or estate plan, but what does the term mean?

Undue influence occurs when someone exerts pressure on an individual, causing that individual to act contrary to his or her wishes to the benefit of the influencer or the influencer’s friends. The pressure can take the form of deception, harassment, threats or isolation. Often the influencer separates the individual from loved ones in order to coerce him or her. The elderly and infirm are usually more susceptible to undue influence.

To prove a loved one was subject to undue influence in drafting an estate plan, you have to show that the loved one disposed of his or her property in a way that was unexpected under the circumstances, that he or she is susceptible to undue influence (because of illness, age, frailty or a special relationship with the influencer), and that the person who exerted the influence had the opportunity to do so. Generally, the burden of proving undue influence is on the person asserting that it took place. However, if the alleged influencer had a “fiduciary relationship”
with the loved one (meaning that the loved one placed a high degree of trust in the influencer to handle his or her affairs), the burden may be on the influencer to prove that there was no undue influence. People who have a fiduciary relationship can include a child, a spouse or an agent under a power of attorney.

When drawing up a will or estate plan, it is important to avoid even the appearance of undue influence. For example, if you are planning on leaving everything to your daughter who is also your primary caregiver, your other children may argue that your daughter took advantage of her position to influence you. To avoid the appearance of undue influence, do not involve any family members who are inheriting under your will in drafting the will. Family members should not be present when you discuss the will with your attorney or when you sign it. To be totally safe,
family members shouldn’t even drive or accompany you to the attorney’s office. You can also get a formal assessment of your mental capabilities done by a medical professional before you draft estate planning documents.

    Client Testimonials

Several years ago, an unreasonable lawsuit was filed against me and my family. I hired Mr. Gilbert Vara, Jr. to represent my case, and that decision is one of the most important ones I have made in my life. Mr. Vara and his very capable Legal Assistant, Krystin Pechacek, treated me in the most professionally proficient manner, handling matters on time and always corresponding with me, while maintaining a friendly and approachable relationship.

Then, when the time came to take the deposition of the person who filed the lawsuit, Mr. Vara questioned her with dignity and professionalism. I was impressed by this man who I would definitely call a Gentleman. I’m happy to say that Mr. Vara won this lawsuit for me. Therefore, I would highly recommend the law firm of Gilbert Vara to anyone, and should the need arise, I will call him again.

When dealing with legal matters such as divorce, my expectations were to keep it as simple and as stress-free as possible. Gilbert Vara certainly made that happen. Gilbert sat with me upfront and went through the details of my situation in order to fully understand my needs as well as what I should expect from him.

He took time to discuss my case, and also took time to understand me personally. Gilbert was very clear in laying out a plan for my benefit, how the matter will proceed and finally come to a close. I was able to talk through anything I did not understand and he and his staff were very helpful keeping me updated with the progress of my case. Finally, the case came to a close as simply as possible and without surprises.

The integrity of this law practice, the concern shown toward the client, and the knowledge base of this practice is sterling in comparison with others in the field. This polished and established law practice completed my Mother's estate in a seamless manner, with timely and succinct communication. Mr. Vara was recommended to myself and my mother to take care of her estate planning, last will and testament, and a family legal matter that needed some attention. Mr Vara was very kind, professional, personable and took the time to get to know us and our unusual legal situation, and our desires as to the outcome of our visit with him. His plan of action was explained to us in length, with plenty of opportunities to ask questions or just give our input about our case. Mr Vara was very pleasurable to work with and the outcome to our situation was resolved in our favor. I think the most pleasurable thing about working with Mr Vara and his staff was that we were kept informed of what was being done, what step in the process we were in. We were always kept informed of the status of our case. Thank you Mr Vara and staff for making what could have been a horrible experience fir my family a less obtrusive experience and resolving our legal issues. I would highly recommend this firm for your legal needs

I could not be more pleased with the legal services I received from Gilbert and his staff. From my first encounter and through the conclusion of my case with his office, Gilbert was the consummate professional, highly sensitive to a very difficult family situation, and 100% available throughout the case. Gilbert was conscientious and thoughtful regarding costs and billing and was proactive in managing my case and minimizing fees where possible. Gilbert's staff reflects his professionalism, experience, and outstanding performance. Krysten was very professional, competent, and kept me informed and connected. One of the most remarkable traits of Gilbert is his ability to bring clarity and understanding to the intricacies, complexities, and complications around guardianships. I recommend The Law Office of Gilbert Vara, Jr. - 5 stars all day!
